1. Acuerdo
1. Este Acuerdo describe los términos y condiciones de uso de nuestros Servicios y rige su acceso y uso de los Servicios proporcionados por Kooth. Debe leer este Acuerdo detenidamente antes de usar o acceder a nuestros Servicios. Al utilizar nuestros Servicios, usted suscribe este Acuerdo y acepta los términos de este Acuerdo.
2. Kooth puede revisar nuestros Términos de servicio en cualquier momento actualizando este Acuerdo y publicándolo. Coaching

Consejería
El asesoramiento, también llamado terapia, es brindado por profesionales de salud mental con licencia. Puede ser a corto o largo plazo, según lo que necesite. La asesoría psicológica te ayuda a resolver una amplia variedad de problemas, desde el estrés diario hasta problemas de salud mental más graves, como la ansiedad o la depresión. La terapia analiza tu pasado, presente y futuro, con el objetivo de encontrar y abordar las causas fundamentales de tus problemas, utilizando métodos basados en la evidencia, como la terapia cognitivo-conductual (TCC), para ayudar a mejorar tu bienestar mental y emocional.

5. Uso del sitio
1. Kooth le otorga una licencia limitada, revocable y no exclusiva para usar nuestros Servicios únicamente para su uso personal y no para su republicación, distribución, cesión, sublicencia, venta, preparación de obras derivadas u otro uso. Usted acepta no copiar los materiales a los que acceda, realizar ingeniería inversa ni irrumpir en nuestro sitio web y/o nuestra aplicación, ni utilizar los materiales, productos o servicios de Kooth en violación de cualquier ley. Mantenerse a salvo

- Muéstrense amabilidad; no se publicarán comentarios groseros u ofensivos
- Sé sensible con los demás y recuerda que las cosas que digas pueden repercutir en ellos
- No intimides ni seas poco amable con otros usuarios del servicio Kooth ni hables de forma violenta o agresiva
- Asegúrese de que su lenguaje sea el apropiado; trate de no usar palabrotas ni lenguaje sexualmente explícito. No se publicará nada que sea homofóbico o racista
- Es importante ser sincero en Soluna y no fingir ser otra persona

- No se tolerará ningún tipo de comportamiento abusivo, violento o amenazante hacia otros usuarios del servicio Kooth o nuestro equipo de profesionales y consejeros de Kooth. Definiciones de uso indebido del servicio
- Uso indebido es cualquier comportamiento que altere la integridad del servicio, viole los límites, consuma recursos desproporcionados o socave el acceso equitativo.
- Bromas son comportamientos intencionales que interrumpen los servicios, engañan al personal o crean falsas crisis.
- Uso indebido del límite de servicio se produce cuando un usuario elude o infringe las restricciones de la plataforma o las reglas de elegibilidad.
- Gratificación sexual es cualquier interacción sexualizada o intento de interacción sexualizada con el personal o en espacios no destinados al contenido sexual.
- Agresión, acoso y amenazas se caracterizan por un comportamiento amenazante, agresivo o acosador hacia el personal o los usuarios del servicio.
- Uso indebido de riesgo inminente se produce cuando un usuario indica falsamente que puede estar en peligro inminente al eludir los límites del servicio, manipular las decisiones o crear una urgencia innecesaria.
- Contacto excesivo no esencial se produce cuando un usuario contacta repetidamente con el Centro de Contacto de Kooth sin la intención de utilizar los Servicios.
Algunos temas son delicados
1. Es posible que escuche la palabra «desencadenante» utilizada en Soluna, un desencadenante es algo que puede desencadenar recuerdos, emociones o sentimientos en otra persona. Es difícil evitar todos los posibles factores desencadenantes, pero hay algunas cosas comunes que no deberían publicarse en Kooth, ya que pueden provocar otras. Es mejor hablar de estos temas con asesores de Kooth, donde hay servicios disponibles, que están capacitados para apoyarte.
- Trastornos de la alimentación: no publicaremos cálculos de estatura, peso o IMC, publicaciones que estén a favor de los trastornos de la alimentación o sean competitivas, descripciones de las conductas de disfunción eréctil ni detalles ni cantidades de alimentos en relación con las conductas de disfunción eréctil

- Sentirse suicida: no publicaremos nada que hable sobre planes suicidas
- Experiencias de abuso o trauma: los detalles de las experiencias de abuso y trauma se discuten mejor con los consejeros, cuando los servicios estén disponibles. Puedes compartir con otras personas tus historias de superación de situaciones difíciles, pero no podremos publicar ningún detalle específico
- Asuntos legales: no podremos publicar nada que hable sobre un delito penal o un comportamiento delictivo
Publicación y descargas
1. En Soluna, todo lo que publicas o envías al sitio es revisado por miembros del personal que moderan lo que has escrito y se aseguran de que no rompa ninguno de los límites de la comunidad.
- A veces, un moderador puede eliminar tu publicación. Quien modere lo que has escrito te enviará un mensaje para informarte si tu publicación no puede publicarse

12. Ley aplicable

13. Separabilidad

14. Exención

15. Terminación
1. Kooth puede rescindir este Acuerdo en cualquier momento, con o sin previo aviso, por cualquier motivo.
16. Relación de las partes
1. Nada de lo contenido en este Acuerdo o en el uso que usted haga de nuestros Servicios se interpretará en el sentido de que una de las partes sea socia, empresa conjunta, empleado o agente de la otra parte, ni ninguna de las partes se declarará como tal. 17. Acuerdo completo

Consentimiento para el tratamiento
Al acceder y utilizar nuestros servicios de asesoramiento de telesalud, usted confirma que es elegible para estos servicios, ubicados en Nueva Jersey o Michigan, y que acepta voluntariamente recibir asesoramiento de profesionales de salud mental autorizados o calificados a través de plataformas en línea seguras.
Usted entiende que:
- La asesoría psicológica puede incluir la discusión de temas delicados o difíciles, lo que a veces puede provocar malestar emocional.
- Si bien el asesoramiento puede ser útil, no se pueden garantizar resultados específicos.
- Tiene derecho a hacer preguntas sobre su atención, participar activamente en las decisiones de tratamiento e interrumpir los servicios en cualquier momento.
Todos los servicios se brindan únicamente a través de telesalud. Usted se compromete a participar en las sesiones en un entorno privado y seguro, sin distracciones ni interrupciones, y a mantener su propia confidencialidad en la medida de lo posible.
Riesgos, beneficios y limitaciones
Kooth brinda servicios de telesalud de acuerdo con las leyes federales y estatales aplicables. Los servicios se brindan a través de telesalud solo cuando usted se encuentra físicamente en un estado donde el proveedor está legalmente autorizado para ejercer.
Beneficios potenciales

Posibles riesgos y limitaciones
- Interrupciones tecnológicas o problemas de conectividad

- Capacidad limitada para responder en persona durante las emergencias
Ubicación, seguridad y privacidad
- Es posible que su ubicación física se confirme en el momento del servicio por motivos reglamentarios y de seguridad.
- La telesalud no sustituye la atención de emergencia. En caso de emergencia, llame al 911 o a los servicios de emergencia locales.
- Los servicios se prestan mediante plataformas seguras y de conformidad con la HIPAA, la Ley HITECH y las leyes de privacidad estatales aplicables. Si bien existen medidas de seguridad razonables, ningún sistema electrónico puede garantizar una seguridad absoluta.
Usted se compromete a participar en las sesiones en un entorno privado y seguro, sin distracciones ni interrupciones, y a mantener su propia confidencialidad en la medida de lo posible.
Menores
Nueva Jersey
- Si bien alentamos la participación de los padres o tutores en el proceso de asesoramiento, si tiene 16 años o más, la ley de Nueva Jersey le permite dar su consentimiento para recibir servicios de salud mental ambulatorios temporales sin la participación de los padres o tutores (N.J.S.A. 9:17 A-4).
- Su tratamiento se considerará confidencial, lo que significa que no compartiremos información con nadie fuera de Kooth, incluidos sus padres o tutores, a menos que:
- Usted otorga un permiso por escrito, o
- La ley exige la divulgación (por ejemplo, si existe un riesgo de daño grave para usted o para otras personas, si se sospecha de abuso o negligencia, o si existe una orden judicial válida).
- Si es menor de 16 años, necesitamos el consentimiento de sus padres o tutores para comenzar el tratamiento, a menos que se aplique otra excepción legal.
Michigan
- Los servicios proporcionados a un menor en Michigan promoverán, en la medida de lo posible, la relación del menor con el padre o tutor y no socavarán los valores que el padre o tutor ha tratado de inculcar en el menor.
- La ley de Michigan permite a los menores de 14 años dar su consentimiento para recibir su propio tratamiento (MCL, sección 330.1707), limitado a no más de 12 sesiones o 4 meses por solicitud de servicios.
- Su tratamiento se considerará confidencial, lo que significa que no compartiremos información con nadie fuera de Kooth, incluidos sus padres o tutores, a menos que:

Reconocimiento

3. Ownership
1. Kooth retains all ownership rights, title and interest (including all intellectual property rights) worldwide to the Services, including to all software and content. No rights are granted to you other than as expressly set forth in these terms. All trademarks, service marks and trade names are owned by Kooth. Except for any information that is in the public domain, you are not authorized to reproduce, transmit or distribute the proprietary information connected with our Services. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use and/or access to our Services. By posting information either through our website or our application, you represent that you have the right to grant permission for use by Kooth.
4. Definition of Services:
Coaching
Coaching is provided by trained coaches who aren’t necessarily licensed mental health professionals. Coaching is short-term and focused on helping you reach specific goals, like improving in school, planning for your future, or making friends. Coaching is about taking action now and looking ahead, using strategies like setting goals and making plans to help you manage everyday stress and challenges.
Counseling
Counseling, also called therapy, is provided by licensed mental health professionals. It can be short-term or long-term, depending on what you need. Counseling helps you work through a wide range of issues, from everyday stress to more serious mental health concerns like anxiety or depression. Counseling looks at your past, present, and future, aiming to find and address the root causes of your challenges, using evidence-based methods like Cognitive Behavioral Therapy (CBT) to help improve your mental and emotional well-being.
What's the difference?
- Who performs the service?
- Coaching: Trained coaches with either a relevant certificate or degree in a mental health related field.
- Counseling: Licensed mental health professionals.
- What is the purpose of the service?
- Coaching: Short term, goal-driven and action-oriented. Designed to help you achieve specific objectives.

1. You might hear the word "trigger" used on Soluna, a trigger is something that can set off memories, emotions or feelings in someone else. It's hard to avoid every possible trigger but there are some common things that shouldn't be posted on Kooth as they might trigger others. These topics are best spoken about with Kooth counsellors, where services are available, who are trained to support you.
- Eating disorders - we won't publish height, weight or BMI calculations, posts that are pro eating disorder or competitive, descriptions of ED behaviors or details and quantities of food in relation to ED behaviors
- Self-harm- we won't publish any posts that contain details of methods of self-harm or descriptions of self-harm injuries
- Feeling suicidal - we won't publish anything that talks about suicidal plans

1. In Soluna, everything that you post or submit to the site is checked by staff members who moderate what you've written and make sure it doesn't break any of the community boundaries.

- You give written permission, or

- Services provided to a minor in Michigan will, to the extent possible, promote the minor's relationship to the parent or guardian and will not undermine the values that the parent or guardian has sought to instill in the minor.
- Michigan law allows minors 14 and older to consent to their own treatment (MCL - Section 330.1707), limited to not more than 12 sessions or 4 months per request for services.

Potential Risks and Limitations
- Technology disruptions or connectivity issues
- Privacy risks inherent to electronic communication
- Reduced ability to observe nonverbal cues compared to in person services
- Limited ability to respond in person during emergencies
Location, Safety, and Privacy
- Your physical location may be confirmed at the time of service for regulatory and safety purposes.
- Telehealth is not a substitute for emergency care. In an emergency, call 911 or local emergency services.
- Services are delivered using secure platforms and in compliance with HIPAA, the HITECH Act, and applicable state privacy laws. While reasonable safeguards are in place, no electronic system can guarantee absolute security.
You agree to participate in sessions in a private, safe environment, free from distractions or interruptions, and to maintain your own confidentiality to the extent possible.
Minors
New Jersey
- While we encourage parent or guardian involvement in the counseling process, if you are 16 years of age or older, New Jersey law allows you to consent to temporary outpatient mental health services without parental or guardian involvement (N.J.S.A. 9:17A-4).
- Your treatment will be considered confidential, meaning we will not share information with anyone outside of Kooth, including your parent or guardian, unless:
- You give written permission, or
- Disclosure is required by law (e.g., if there is a risk of serious harm to yourself or others, suspected abuse or neglect, or a valid court order).
- If you are under the age of 16, we require parental or guardian consent to begin treatment, unless another legal exception applies.
Michigan
- Services provided to a minor in Michigan will, to the extent possible, promote the minor's relationship to the parent or guardian and will not undermine the values that the parent or guardian has sought to instill in the minor.
- Michigan law allows minors 14 and older to consent to their own treatment (MCL - Section 330.1707), limited to not more than 12 sessions or 4 months per request for services.
- Your treatment will be considered confidential, meaning we will not share information with anyone outside of Kooth, including your parent or guardian, unless:
- You give written permission, or
- Disclosure is required by law (e.g., if there is a risk of serious harm to yourself or others, suspected abuse or neglect, or a valid court order).
- If you are under the age of 14, we require parental or guardian consent to begin treatment, unless another legal exception applies.
Please note that these laws may change, and this policy reflects the law as of February 2026. We will inform you if changes affect your eligibility to consent or your confidentiality rights.
Acknowledgment
By continuing to use our services, you confirm that:
- You understand the nature of telehealth mental health counseling.
- You are providing your informed consent to participate.
- If you are under 18, you are either legally permitted to consent under New Jersey or Michigan law, or you have obtained necessary parental or guardian consent.
